****The Menlo Atherton High School newspaper, M-A Chronicle, filed a frivolous copyright claim against this post in attempt to censor the release of the film. Our Fair Use argument was sound and Substack has allowed us to republish this page. However, there were significant damages caused by the paper’s frivolous actions and we may consider legal action to find out exactly who was behind this censorship.
Hi all,
The unmerited efforts to suppress Killing America continue and I decided this morning that I would release the full 38 minute documentary on all possible online platforms today at 5 PM PST.
All the links are posted below, but, first, here are a few of my thoughts.
If you saw my Substack article yesterday, then you know that M-A Chronicle, the school newspaper for Menlo-Atherton High School, filed a copyright claim that forced YouTube to remove the Killing America trailer. We filed a counter-claim and have not heard anything yet, severely hurting our ability to market the film.
And as you know, I posted the film on Vimeo and provided the link to you. Well, it was removed shortly after I posted yesterday’s Substack article. I learned that the person that filed this legal DCMA request was a minor, a Menlo-Atherton High School Student. I’m not a lawyer, but since when are minors allowed to file legal claims and put their names on legal documents? High school newspapers are overseen by teachers and the question here is why would the journalism advisor allow a minor file such a claim that ignores, willfully or not, the Fair Use doctrine? Where was the principal, the superintendent, the district board, or any adult? This is nothing short of journalism malpractice.
And then there is the cease and desist letter that I received this past Tuesday evening, demanding that I remove several key clips from the full documentary within ten days. Again, this is based on a copyright claim.
But let’s be clear what this fight is really about. The M-A Chronicle claims that this is a copyright issue, but it is not. Our work is fully protected by the Fair Use doctrine, which allows us to use copyrighted footage under certain guidelines.
What you are witnessing here is the weaponization of the copyright law to prevent my film from being shown in its full form. The Sequoia Union High School District, where this student newspaper is located, has been a hotbed of activism for quite some time now. Activists spent the last 8 years removing honors classes in the name of racial equity. They injected the ideology of liberation ethnic studies into many of its classes. They released lengthy statements after George Floyd and largely ignored the October 7th massacre and the dramatic rise of antisemitism. They allowed the teacher featured in our documentary to teach outright lies about the Hamas-Israel war. And on.
The “crime” that Killing America commits is telling the truth during these ideological times and that is why I have no doubt that these activists are doing everything to weaponize the copyright issue in order to suppress my film. This is nothing less than Left-wing activism that cannot stand dissent to the ideological order they seek to impose on our schools as well as our larger society.
That is why I’m releasing the film now — to force the following issues to the forefront:
Free Speech — what are we teaching students at high school newspapers when we tell them to embrace censorship, not free speech, as their weapon of choice?
Artistic Expression — are we going to let documentaries and other art forms be censored by activists, especially those in wealthy, elite neighborhoods?
Hate/Antisemitism — Why has this school and district largely ignored the rising antisemitism on campus? We know if it was blacks who were on the receiving end, the response would be different. This double-standard must end.
Ideological Capture/Lowering of Education Standards — For too long these education activists, many from Stanford University and beyond, have been given free reign to impose their ideologies onto students. As a result, the quality of education has declined significantly.
People often ask why I made Killing America and Diana Blum, the film’s main subject, once said something that summed up my thoughts perfectly: “With this film, I wanted to give parents a voice because they’ve been silenced and ridiculed for so long by the school board, activist teachers, and the school authorities. This film is our way to get around that ideological resistance and be heard for once and for all.”
I don’t have to say it but the irony here is that it is these education ideologues that are trying to take our voice away once again.
So, here is Killing America in all her glory and lets pray we can share this film widely without any censorship:

Lastly, I would normally charge a fee for watching this film because it was a labor of love that I did because this film needed to get made and because I want the word out as widely as possible. In many ways, I see this film as a continuation of my family’s legacy of civil rights activism began in 1942.
At the same time, I have received requests from people wishing to donate a small fee for watching the film or to help cover the cost of making the film as well as legal fees. I truly appreciate that since this film has taken on a life of its own that I never imagine possible. Please subscribe to Substack below or here is the donation link.
Thank you for your support and I will keep you posted — certainly if we face more censorship.
All my best,
Eli
Eli, here's a suggestion. Why not contact Bari Weiss? You and she are on the same page on the topics of DEI, equity, and anti-Semitism. She's got a huge readership and she might be willing to post the film for free on The Free Press in the same formats as you sent it around (YouTube, Substack, Rumble, etc.) with an explanation by you or her. I believe that many of her readers would be interested in seeing the film. It's very good...painful, infuriating, inspiring and crystal clear. There's no better narrator than your father.
And yes, I see why the school wants to censor the film. It's fascinating how self-righteous people can be when they think they have all the power and are controlling the narrative. But when they're exposed, they get all camera shy. Shameful.
Thank you for making this available to everyone. It’s well done and very moving. I find it incredibly frustrating that order, reason and common sense have been forced to take a back seat in culture by people who are sure they already know everything there is to know. It also sickens me that these children are being weaponized in our culture war and the parents are being silenced. Well done.
