Is there a GoFundMe account to help offset Daniel’s court costs? I would contribute if one is set up. Thank you for the reference to O.J. Simpson trial. In a news report in the St. Louis Post-Dispatch at the time of the verdict Cornell West said it was just because of “racial nullification” for all the black men who were found guilty when innocent. If this young man is convicted it will cement the idea of NEVER helping someone in trouble. I am sick about it.

The Medical Examiner allegedly called it a homicide before the autopsy and toxicology results came in. This is corruption with a capital C. It's setting back race relations by decades, because what I'm learning is not to trust certain people with positions of power. This is not to say that other people can be entrusted with it -- only that there is too much evidence of blatant racism lately in the likes of Alvin Bragg, Lori Lightfoot, etc.

The entire thing is absurd. Cops said the dead guy had a pulse when they got there & relieved Penny of doing their job. So - obviously - Penny didn’t kill him. It’s Fat Alvin who needs to be prosecuted for all the thugs ruining NYC…

Thank you Eli for this update and wise assessment of the charade of division we now experience as perpetrated by some of those in power. I know who I am and although not perfect I have spent a lifetime evaluating others based on their treatment of myself and others regardless of their wealth, height, eye color, athletic ability and oh yea, race, sex, religion, etc. I’ve ridden the subways in NYC hundreds of times and many times felt threatened by unstable at best and often violent MEN who everyone on board was afraid of. I hated the L most of all with the long ride under the Hudson making police less likely to catch criminals. I’m so sad for Mr Penny who risked his life to help others and ends up being used as a pawn in an evil plot to further the career of a race grievance industry grifter. Thanks for shinning a light on this important miscarriage of justice.

Thank you. I’ve left the US permanently - but as a former New Yorker I watch this case with incredulity and sadness. Penny is a hero. His benevolence ended in a tragedy. But not a crime. The DA has proven himself incompetent time and time again. Meanwhile, if there’s a miscarriage of justice and Penny is convicted, can the Governor pardon him in the same manner that the President has pardon power for federal crimes?

So sad! Black people have such an opportunity to rise above these shallow destructive prejudices. They, of all, should know that kind of treatment breeds a social poison that degrades everyone - especially the abuser.

I pray that more intelligent, healed/healthy Black people will rise among us to model for all the grace of the divine, like giants among us all.

Thank you for your moving and disturbing account. I would add, as a footnote, that living in NYC is an exercise in masochism. In return for high taxes and high rents one gets a subway system that is a playground for violent lunatics and a racist justice system. I was born and raised in NYC and lived there for many years. I moved away in 2007, never to return. It was one of the best decisions of my life.
